EchoWell Terms of Service

By downloading, installing, accessing, or using the EchoWellsoftware application (“App”) developed and distributed by VRYTIS LABS (“we,” “us,” or “our”), you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms of Service (“Terms”).

These Terms constitute a legally binding agreement between you and VRYTIS LABS. If you do not agree to every provision of these Terms, you must not install, access, or use the App, and you must immediately uninstall and remove all local copies of the App from your Android devices.

Your continued use of EchoWell following any posted updates to these Terms on our official website at https://vrytislabs.com/echowell/terms constitutes your full acceptance of such changes.

EchoWell is an Android utility designed for ambient soundscape creation, deep work focus, and restorative relaxation. The App provides:

• Multi-Track Ambient Sound Mixer: Simultaneous playback and individual volume balancing of multiple procedural and natural acoustic tracks (including procedural rain algorithms, Brownian noise, delta binaural beats, ocean swells, coffee shop chatter, ambient synth pads, and natural thunder).
• Sleep Timer: Configurable countdown timers with gradual volume fade-out routines designed to conclude playback gently.
• Pomodoro & Focus Intervals: Structured session timers supporting customizable work sprints and restorative rest periods.
• Habit Streak Tracking: On-device tracking of daily focus sessions and usage milestones.
• Home Screen Glance Widget: Fast, one-tap Android Glance app widgets for starting, pausing, and resuming favorite sound mixes directly from your device home screen.
• Scheduled Reminders: User-configured local notifications reminding you to initiate mindfulness or focus sessions.
• 100% Offline Architecture: All audio synthesis and playback logic execute locally on your device without backend cloud servers, tracking libraries, or mandatory network connectivity.

You must be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction of residence, to agree to these Terms independently.

If you are under 18 years of age (or under the age of majority in your jurisdiction), you represent and warrant that you are using EchoWell only with the consent and active supervision of your parent or legal guardian, who has reviewed and agreed to these Terms on your behalf.

The App is not intended for unsupervised use by children under the age of thirteen (13), or under sixteen (16) in the European Economic Area.

By using EchoWell, you expressly acknowledge and agree that:

• No Clinical Treatment: The App does not provide medical therapy, psychological counseling, or clinical interventions for chronic insomnia, sleep apnea, clinical anxiety, major depression, attention deficit disorders, hearing loss, or tinnitus.
• Informational Audio Only: All acoustic tracks, procedural noise synthesizers (such as Brownian or Rain noise), and binaural frequency differentials (such as 200 Hz/206 Hz delta waves) are purely algorithmic acoustic patterns. They are not medical treatments or scientifically guaranteed sleep induction therapies.
• Consult Healthcare Professionals: If you experience persistent sleep disturbances, chronic fatigue, anxiety disorders, severe ear ringing (tinnitus), or auditory pain, you should immediately consult a licensed medical doctor, audiologist, or certified mental health professional. Never disregard or delay seeking professional medical advice because of content, soundscapes, or timer schedules in the App.

Your safety and sensory health are of utmost importance. You agree to use EchoWell responsibly and in accordance with the following mandatory safety guidelines:

• Do Not Use While Driving or Operating Machinery: NEVER use EchoWellwith headphones, earbuds, or at high volume while driving a motor vehicle, riding a bicycle, crossing traffic, operating heavy equipment, or engaging in any activity where your ability to hear auditory warning signals (such as horns, sirens, alarms, or approaching traffic) is necessary for your safety or the safety of others.
• Hearing Protection & Safe Volume Levels: Prolonged exposure to high audio volumes through headphones or earbuds can cause permanent hearing damage, acoustic trauma, or persistent tinnitus. You are solely responsible for maintaining device volume at a moderate, comfortable, and safe sound pressure level.
• Battery Saver & Background Execution Notice:The App's sleep timer fade-out routines and scheduled reminder notifications rely upon Android operating system scheduling APIs (such as AlarmManager and WorkManager). These functions may not trigger or may be delayed if your Android device is placed in Battery Saver Mode, extreme power-saving profiles, “Do Not Disturb” modes, or if OEM system task-killers terminate background processing. Do not rely on EchoWell timers as a critical or life-safety alarm clock.

To provide seamless soundscape playback and user-configured reminders, EchoWell utilizes the following Android system capabilities:

• Media Playback Foreground Service: The App utilizes AndroidX Media3 foreground services (FOREGROUND_SERVICE_MEDIA_PLAYBACK) to maintain unbroken audio synthesis when your screen is locked, when you switch between apps, or when operating in the background. A persistent system media notification enables playback controls (play, pause, stop).
• Scheduled Notifications: If you configure restorative break alerts or focus session reminders, the App requests permission (POST_NOTIFICATIONS) to deliver local alerts. All notifications originate strictly from local device alarms; the App connects to no external push servers.
• User Control: You can modify notification preferences or revoke background permissions at any time through your Android device system settings.

EchoWell is engineered with a strict privacy-first, offline-only architecture. The App does not require user accounts, passwords, or personal profile creation.

All data generated during your usage — including custom audio mix presets, volume slider states, timer durations, session logs, and habit streak tallies — is stored exclusively on your physical Android device in local SQLite tables (Room database) and DataStore preferences. This information is never transmitted to, inspected by, or stored on servers operated by VRYTIS LABS.

You agree to use EchoWell solely for lawful, personal, non-commercial relaxation, meditation, and ambient focus.

You strictly agree that you shall NOT, directly or indirectly:

• Decompile, reverse-engineer, disassemble, decode, decipher, or otherwise attempt to derive or access the source code, internal audio DSP algorithms, or binary packages of the App.
• Rely on automated audio ripping tools, memory scrapers, or recording software to extract, duplicate, capture, sample, or rip the underlying audio loops, procedural synthesis models, or acoustic samples from the App.
• Redistribute, rebroadcast, sublicense, sell, rent, lease, stream publicly for commercial admission, or create derivative sound packs or audio libraries derived from EchoWell's sound content.
• Modify, adapt, patch, or create derivative software applications based upon the App or its code.
• Bypass, disable, or tamper with any system permission controls, sandboxing boundaries, or device integrity mechanisms.
• Use the App for any fraudulent, unlawful, or dangerous purpose in violation of applicable laws or safety standards.

The App, including its software code, user interface designs, Jetpack Compose layouts, graphics, icons, visual identity, brand names, and trademarks, is the exclusive intellectual property of VRYTIS LABS.

Audio Content Licensing: The soundscapes within EchoWell comprise proprietary real-time mathematical procedural audio algorithms and embedded acoustic audio recordings utilized under applicable licenses from their respective creators and sound libraries. All audio content is licensed exclusively for in-app interactive mixing and playback. No rights are granted to extract, redistribute, publicly perform, sample, or commercially exploit the audio files separately from the App.

Limited License: Subject to your compliance with these Terms, VRYTIS LABS grants you a revocable, limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and execute EchoWell on personal Android devices for non-commercial personal use.

Your acquisition, download, and updating of EchoWell through the Google Play Store is subject to the Google Play Terms of Service.

Underlying Android open-source components (including Jetpack Compose, AndroidX Media3, and Glance) are distributed under their applicable open-source licenses (such as the Apache License, Version 2.0). The App does not integrate any third-party advertising SDKs, behavioral tracking trackers, or remote telemetry frameworks.

We are committed to delivering polished, high-fidelity software. However, EchoWell is provided on an “AS IS” and “AS AVAILABLE” basis.

We reserve the right to update, modify, expand, or adjust sound models, acoustic track selections, timer features, or supported Android OS specifications at any time. Because EchoWell operates locally without cloud servers, existing offline playback and saved mix presets on your device remain functional regardless of external network conditions.

PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS OUR LEGAL RESPONSIBILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VRYTIS LABS AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AND AFFILIATES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, STATUTORY, OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
• WARRANTIES THAT ECHOWELL WILL INDUCE SLEEP, CURE TINNITUS, IMPROVE COGNITIVE FOCUS, OR ALLEVIATE STRESS OR ANXIETY IN ANY SPECIFIC USER.
• WARRANTIES THAT AUDIO PLAYBACK WILL BE UNINTERRUPTED, GLITCH-FREE, OR COMPATIBLE WITH ALL BLUETOOTH CODECS, HEADPHONE CONTROLS, OR CUSTOM ANDROID ROMS.
• WARRANTIES THAT TIMERS OR REMINDER ALERTS WILL FIRE WITHOUT DELAY WHEN THE DEVICE IS PLACED IN AGGRESSIVE OEM BATTERY OPTIMIZATION MODES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VRYTIS LABS, ITS CREATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE ECHOWELL.

THIS LIMITATION APPLIES TO, WITHOUT LIMITATION:

• HEARING LOSS, AUDITORY INJURY, OR TINNITUS RESULTING FROM LISTENING AT EXCESSIVE VOLUME LEVELS.
• VEHICULAR ACCIDENTS, TRAFFIC INCIDENTS, OR PERSONAL INJURY RESULTING FROM USE WHILE DRIVING, CYCLING, OR OPERATING EQUIPMENT.
• MISSED ALARMS, APPOINTMENTS, OR WORK COMMITMENTS RESULTING FROM SLEEP TIMERS OR DEVICE BATTERY DEPLETION.
• LOSS OF LOCALLY STORED SOUND MIX PRESETS OR HABIT STREAK RECORDS FOLLOWING OS UPDATES OR APP CACHE CLEARING.

UNDER NO CIRCUMSTANCES SHALL THE TOTAL AGGREGATE LIABILITY OF VRYTIS LABS ARISING FROM OR RELATING TO THESE TERMS OR ECHOWELL EXCEED THE AMOUNT ACTUALLY PAID BY YOU (IF ANY) TO US FOR THE APPLICATION, OR FIVE HUNDRED INDIAN RUPEES (INR 500 / APPROXIMATELY $10 USD), WHICHEVER IS GREATER.

You may terminate your agreement with these Terms at any time by ceasing all use of the App and uninstalling it from all your devices. Clearing application storage in your Android device settings completely purges all local mix presets and session streak history.

VRYTIS LABS reserves the right to restrict or terminate your license to use the App immediately and without prior notice if you violate any provision of these Terms, including but not limited to unauthorized audio extraction, decompilation, or redistribution of proprietary sound assets.

Upon termination, all licenses granted to you herein shall cease immediately. Sections 4, 5, 8, 9, 12, 13, 16, and 17 shall survive any termination.

We may revise, update, or amend these Terms from time to time to reflect modifications in application features, statutory legal obligations, or Google Play store policy requirements.

When revisions occur, we will update the “Last updated” timestamp at the top of this page and publish the current terms at https://vrytislabs.com/echowell/terms. We recommend reviewing this document periodically.

Your continued use of EchoWell following the publication of revised Terms signifies your binding agreement to the updated terms. If you do not accept the updated terms, you must discontinue use and uninstall the App.

These Terms, their interpretation, and any disputes, claims, or controversies arising out of or relating to these Terms or your use of EchoWell shall be governed by, construed, and enforced in accordance with the substantive laws of India, without giving effect to any principles of conflicts of law.

Subject to applicable mandatory consumer protection laws, you agree that any legal action, suit, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the competent courts located in West Bengal, India, and you submit to the personal and exclusive jurisdiction of such courts.

Consumer Rights Reservation: Nothing in these Terms limits, diminishes, or excludes any non-waivable statutory rights or remedies that you may enjoy as a consumer under mandatory local consumer protection legislation in your country of residence that cannot be excluded by contractual agreement.
